Terms and Conditions
These Terms govern access to and use of Tõlk.fm (also written as Tolk.fm), a live AI translation, captions, and event audio service operated by Pixibit OÜ.
1. Provider and acceptance
Tõlk.fm is provided by Pixibit OÜ, an Estonian private limited company registered under registry code 14153351, with registered address Võlvi tn 6, Kesklinna linnaosa, Tallinn, Harju maakond, 10132, Estonia. In these Terms, “Tõlk.fm”, “we”, “us”, and “our” mean Pixibit OÜ.
By creating an account, joining an event, buying credits, uploading media, streaming audio, or otherwise using Tõlk.fm, you agree to these Terms and our Privacy Policy. If you use Tõlk.fm for an organisation, you represent that you may bind that organisation.
2. Service description
Tõlk.fm lets organisers create event rooms, stream or upload source audio, choose target languages and providers, generate captions or translated audio, share QR codes or join links, monitor usage, and manage billing. The service may include live AI translation, speaker monitoring, open-mic audience capture, prepared dubbing, replay or playback features, diagnostics, and related support.
Tõlk.fm is a technology service, not a professional interpreting agency, legal adviser, medical adviser, emergency communication system, or guaranteed accessibility service.
3. Eligibility and accounts
- You must be at least 18 years old to create an account, administer events, purchase services, or use paid AI-provider functionality through Tõlk.fm.
- You must provide accurate account, billing, and tax information and keep it up to date.
- You are responsible for all activity under your account, workspace, event links, join codes, API keys, and admin credentials.
- You must promptly notify us if you suspect unauthorised access or misuse.
4. Organiser obligations
Event organisers control the context in which Tõlk.fm is used. Organisers must ensure that their event use is lawful and appropriate before starting an event.
- Provide clear notices that audio may be streamed to AI providers and translated or captioned by automated systems.
- Obtain any required consent, contract terms, legitimate-interest assessments, recording permissions, performer releases, venue permissions, employee consultation, union approvals, safeguarding approvals, or accessibility notices.
- Do not capture audience microphones, speaker feeds, private conversations, confidential sessions, or children’s voices unless legally permitted and properly announced.
- Use only media and voices for which you have sufficient rights, including copyright, neighbouring rights, performer rights, publicity rights, and venue rights.
- Choose provider, language, retention, and region settings suitable for the event, audience, and data sensitivity.
- Provide human interpreters or other alternatives where required by law, contract, accessibility needs, safety context, or event expectations.
5. AI outputs and provider rules
AI translation can be wrong. Outputs may contain omissions, hallucinations, delays, mistranslations, offensive wording, incorrect speaker attribution, inaccurate captions, or unsuitable tone. You must not rely on Tõlk.fm as the sole source of truth for high-stakes matters, including medical, legal, financial, immigration, employment, safety, emergency, or regulated decisions.
- OpenAI, Google/Gemini, ElevenLabs, Stripe, Supabase, hosting providers, and other third-party services may apply their own terms, policies, safety rules, regional restrictions, and data-processing terms.
- If Gemini API is used for users in the European Economic Area, Switzerland, or the United Kingdom, Tõlk.fm must use paid Gemini services, and you must not configure Tõlk.fm to route those users through unpaid Gemini API services.
- You must not bypass provider safety systems, reverse engineer models, extract model weights, use outputs to build competing foundation models where prohibited, or submit content that violates provider prohibited-use policies.
- You are responsible for reviewing AI outputs before publishing, archiving, making official records, or taking action based on them.
6. Content rights and licences
As between you and Tõlk.fm, you retain ownership of audio, text, media, event materials, prompts, feedback, and other content you submit, subject to rights held by speakers, performers, venues, licensors, attendees, and other third parties.
You grant Tõlk.fm a worldwide, non-exclusive, royalty-free licence to host, transmit, reproduce, process, translate, generate, display, and store your content as necessary to provide, secure, troubleshoot, support, improve, and enforce the service and these Terms. This licence includes the right to send content to subprocessors and AI providers as described in the Privacy Policy and any applicable data processing agreement.
You represent that you have all rights, permissions, and notices required to submit the content to Tõlk.fm and to allow us and our providers to process it for the requested service.
7. Plans, credits, payments, and withdrawal
- Prices, plans, credits, included minutes, overages, and taxes are shown at checkout or in the billing page unless a separate signed order form applies.
- Usage may be charged per event, language channel, AI session, minute, generated media item, storage, or other metered unit. One event can create multiple provider sessions, for example one AI session per target language.
- Payments are processed by Stripe or another payment provider. We do not store full payment card numbers.
- Credits, subscriptions, and metered services may expire, renew, or be consumed according to the plan terms shown when purchased.
- If you are a consumer in the European Union, you may have a 14-day withdrawal right for distance contracts. You agree that digital services may start immediately after purchase or event activation; where the service has been fully performed or digital content has been supplied after your express request and acknowledgement, the withdrawal right may not apply or may be reduced as permitted by law.
- Refunds are provided only where required by law, stated in the plan terms, or approved by us. Fees already consumed by third-party AI, media, infrastructure, or payment providers may be non-refundable unless law requires otherwise.
8. Acceptable use
You must not use Tõlk.fm to:
- break the law, infringe rights, violate privacy, secretly record where prohibited, or process personal data without a lawful basis;
- submit malware, exploit vulnerabilities, attack infrastructure, overload systems, scrape, spam, phish, or evade rate limits;
- generate, transmit, or promote illegal, hateful, harassing, exploitative, sexually abusive, terrorist, self-harm, or violent extremist content;
- impersonate others, misrepresent AI outputs as certified human interpretation, or remove required AI disclosures;
- use the service for emergency dispatch, clinical practice, medical-device functions, legal advice, regulated financial advice, or other contexts where automated translation is not legally or practically appropriate;
- submit sensitive personal data, confidential information, trade secrets, or children’s data unless you have confirmed that the service and providers are appropriate and lawful for that use;
- resell, white-label, benchmark, or provide Tõlk.fm as a managed service without written permission.
We may suspend or restrict events, accounts, content, or provider access if we believe use is unlawful, unsafe, abusive, unpaid, harmful to service integrity, or contrary to these Terms or provider rules.
9. Privacy and data processing
Personal data is handled as described in the Privacy Policy. If we process event content on behalf of an organiser subject to GDPR, our data processing terms or signed data processing agreement form part of the customer agreement. If there is a conflict between these public Terms and a signed enterprise agreement, the signed agreement controls for that customer.
10. Availability and changes
We aim to provide reliable service, but live audio, AI translation, cloud infrastructure, browsers, networks, payment systems, and third-party providers can fail or change. We do not guarantee uninterrupted, error-free, low-latency, or permanently available service. Features, providers, models, languages, prices, quotas, and limits may change, be suspended, or be discontinued.
You are responsible for rehearsals, fallback plans, human interpreters where needed, onsite connectivity, audio quality, backup equipment, and notifying participants if translation is degraded or unavailable.
11. Disclaimers and liability
To the maximum extent permitted by law, Tõlk.fm is provided “as is” and “as available”. We disclaim warranties of accuracy, fitness for a particular purpose, non-infringement, uninterrupted operation, and suitability for regulated or high-stakes uses.
To the maximum extent permitted by law, Pixibit OÜ is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits; lost revenue; loss of goodwill; loss of data; event disruption; inaccurate translations; provider outages; or third-party claims arising from your content, notices, permissions, or use of AI outputs.
Our aggregate liability for claims relating to Tõlk.fm is limited to the greater of (a) the amount you paid to us for the service giving rise to the claim during the three months before the event causing liability, or (b) €100. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for intentional misconduct or mandatory consumer rights.
12. Termination
You may stop using Tõlk.fm at any time. You may close your account or workspace subject to outstanding fees, legal retention, security needs, backups, and any signed agreement. We may suspend or terminate access if you breach these Terms, fail to pay, create legal or security risk, violate provider rules, or use the service in a way that could harm Tõlk.fm, users, providers, venues, or the public.
Sections that by their nature should survive termination will survive, including payment obligations, content licences needed for completed processing, privacy/data processing, disclaimers, liability limits, dispute terms, and enforcement rights.
13. Governing law and disputes
These Terms are governed by the laws of the Republic of Estonia, without regard to conflict-of-law rules. If you are a consumer, you may also have mandatory rights under the law of your country of residence.
We encourage you to contact legal@tolk.fm first so we can try to resolve issues informally. If a dispute cannot be resolved, disputes are subject to the courts of Estonia unless mandatory consumer law gives you another forum. EU consumers may also have access to consumer dispute-resolution channels required by law.
14. Changes and contact
We may update these Terms as the service, providers, pricing, law, or business needs change. The updated version will be posted on this page. Material changes may also be notified by email, in-product notice, or checkout notice. Continued use after changes take effect means you accept the updated Terms.
